Terms and Conditions

The following Terms and Conditions apply to all of Mariëlle Spronck, Avalanche Bodywork, mariellespronck.com and pelvic-release.com’s services:
 

UNDERSTANDING

1. The terms and conditions below apply to all services, online and live trainings, sessions and other events provided by Mariëlle Spronck under the flag of Avalanche Bodywork or Pelvic Release to any individual or organization (“the client”).

2. Coaching, sessions, trainings or workshops are not psychological counseling or any type of therapy, and should not be construed as such.

3. In return for the fees payable by the client (or by a third party on their behalf), Mariëlle agrees to provide the service as described and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

4. The date that the first session or intake takes place shall be deemed to be the start date for the service. Participation by any individual in the first session, intake or workshop constitutes acceptance of these terms and conditions.

REFUNDS 
Pelvic-release.com does not offer refund or exchange on products or online services and trainings.

Sessions can be canceled up until 48 hours before.
Live trainings and workshops can be canceled up until 3 weeks before.

After that the full amount will be the charged.
Tickets may be sold to another person for the current price of a ticket after consulting Mariëlle about it. If there is a waiting list, Marielle will connect you to the next one on the waiting list or suggest a way to transfer the ticket.

Mariëlle charges an administrative fee of €25 for every cancelation.
In exceptional circumstances Mariëlle may need to rearrange a session or a training; in these circumstances Mariëlle will use reasonable endeavors to provide a mutually satisfactory alternative appointment the client.
When a session, workshop or training cannot take place at the planned dates because of natural disasters, governmental legislation or any other situation outside of Marielle Spronck’s domain of decision making or influence, the session, workshops or trainings will be canceled without the client receiving refunds for payments already made.

Without our prior written consent, you may not download, copy or store Pelvic Release content in any form and you may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, or distribute any Pelvic Release content. You agree to cooperate with us in protecting our proprietary and intellectual property rights on pelvic-release.com and in the online training. All intellectual property rights on pelvic-release.com are the sole and exclusive property of Mariëlle Spronck.
 

RESTRICTIONS AND PROHIBITED USES 
As a condition of your use of pelvic-release.com, mariellespronck.com and the content of workshops, trainings and sessions, you agree that you will not use any material or information provided on the website or in the workshops, trainings and sessions for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the website in any manner that could damage, disable, overburden, or impair any Pelvic Release practitioner, or the network(s) connected to any practitioner, or interfere with any other party’s use and enjoyment of any material or information provided. You may not attempt to gain unauthorized access to the online training, through hacking, password sharing or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available by Mariëlle Spronck.
The techniques and exercises taught in the (online and live) trainings and sessions are for private use only.
You can't use any of the (online and live) trainings and sessions (with the exception of the Pelvic Release Practitioner Training) to offer sessions or trainings professionally. 

ADULTS ONLY 
The videos, images, text and exercises in the Pelvic Release Online training, live trainings and sessions have been created and designed to be used by adults to aid in the learning and instruction of Pelvic Release, as developed and taught by Mariëlle Spronck and the Pelvic Release practitioners. You must be at least 18 years of age.

You agree that the material in the online training and in the workshops, trainings and sessions is for your own educational use. You confirm that you desire to view and interact with the material. You confirm that you believe that the act of a consenting adult engaging in touching their genitals or two consenting adults, wherein one consenting adult touches the genitals of a consenting adult, pursuant to the steps, form and container of the Pelvic Release as developed and taught by Mariëlle Spronck and the Pelvic Release practitioners and as depicted in images, video’s and exercises is neither offensive nor obscene. You confirm that the viewing and reading of these materials does not violate the standards of your community, town, city, state or country.

You are solely responsible for any false disclosures or legal ramifications of viewing or reading any material contained on pelvic-release.com or the online training. Furthermore, you agree that pelvic-release.com and Pelvic Release affiliates shall not be held responsible for any legal ramifications arising from fraudulent entry into or use of this website.
 

DISCLAIMERS 
You agree that use of pelvic-release.com, participating in the trainings and sessions is at your own sole risk. Marielle Spronck, the Pelvic Release practitioners, pelvic-release.com are not responsible for any decisions you may make following a session, workshop, (online or live) training or physical results or problems that may arise afterwards.  Mariëlle has no liability for any loss incurred by any client, following commencement of sessions, (online or live) trainings or workshop or for any perceived failure by the client, whether justified or otherwise, to achieve improvement in quality of life or to achieve their desired outcomes or goals.

Mariëlle Spronck, a Pelvic Release practitioner or pelvic-release.com is not a healthcare provider nor a medical or health service and therefore the sessions and trainings are not to be used for the purpose of seeking, and are not providing, medical treatment or advice.
Always consult your medical doctor if you have any doubts before, during or after working with Pelvic Release.

 

INDEMNITY 
You will indemnify and hold harmless Mariëlle Spronck, pelvic-release.com, mariellespronck.com, its affiliates and/or employees, including by paying costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of your participation in a session, a workshop, (online or live) training or the violation of the Terms and Conditions by you.

SEVERABILITY AND WAIVER 
If any part of the Terms and Conditions is held invalid or unenforceable, the remaining provisions will remain in full effect. Either party’s failure to enforce any term or condition is not a waiver of its right to do so later.

PRIVACY AND PROTECTION OF PERSONAL INFORMATION 
See Mariëlle Spronck’s Privacy Policy relating to the collection and use of your information.
 

CHANGE POLICY 
We may change, add or remove portions of the Terms and Conditions at any time, which shall become effective immediately upon posting. It is your responsibility to review the Terms and Conditions prior to each use of pelvic-release.com, mariellespronck.com and related trainings and sessions and by continuing or participating in a training or session you agree to any changes.

These terms and conditions have last been amended on October 3, 2019.
